BoatRex Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BoatRex.com and the websites, features, and services offered by BoatRex (“BoatRex,” “we,” “us,” or “our”), collectively the “Services.” By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be at least 18 years old and legally able to enter into a binding agreement to use the Services. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. Notify us promptly if you believe your account has been accessed without authorization.

2. The BoatRex Services

BoatRex provides tools and directories that allow users to create and manage boat listings, upload photos, locate boating-related businesses and destinations, contact providers, manage boating information, and purchase paid features. We may add, change, suspend, or discontinue features at any time.

BoatRex is a listing and information service. Unless expressly stated otherwise, BoatRex is not a party to transactions, communications, inspections, agreements, or disputes between users, buyers, sellers, marinas, storage facilities, dealers, brokers, or other service providers. We do not broker, verify, or guarantee any transaction.

3. Listings and User Content

You retain ownership of descriptions, photos, messages, and other content you submit (“User Content”). You grant BoatRex a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, format, display, distribute, and otherwise use your User Content as reasonably necessary to operate, promote, secure, and improve the Services. This license ends when the content is deleted from our active systems, except where retention is legally required or technically necessary.

You represent that you own or have rights to submit your User Content, that your content is accurate, and that it does not violate any law or rights of others. Public listing content may be viewed, copied, or shared by others. You are responsible for deciding what information to make public.

4. Listing Rules

You agree that listings and other submissions will be accurate, lawful, and not misleading. You may not list property you are not authorized to offer, impersonate another person or business, conceal material facts, manipulate pricing or availability, or use the Services to facilitate fraud or unlawful activity.

BoatRex may review, reject, edit, restrict, or remove content that violates these Terms or may harm users or the Services. BoatRex is not obligated to moderate content.

5. Communications and Transactions

The Services may allow you to contact other users or listed businesses. You are solely responsible for your communications, inspections, negotiations, contracts, payments, and other dealings.

BoatRex does not guarantee that any listing, user, business, product, or service is accurate, available, safe, licensed, insured, or suitable for your needs. You must verify identities, ownership, condition, pricing, licensing, insurance, and other material details before entering a transaction.

6. Fees, Subscriptions, and Payments

Certain features may require payment. Prices, billing frequency, and applicable terms will be shown before purchase.

By purchasing a paid feature, you authorize our payment processor to charge the payment method you provide. Recurring subscriptions continue until canceled and may renew automatically at the disclosed interval.

You may cancel a subscription through available account controls or by contacting us. Unless otherwise stated or required by law, fees already paid are non-refundable. We may change prices with advance notice as required by law. You are responsible for applicable taxes.

7. Acceptable Use

You may not:

• use the Services for unlawful, fraudulent, deceptive, abusive, or harmful purposes;
• submit malicious code or interfere with the Services;
• bypass security measures or attempt unauthorized access;
• scrape, harvest, or copy Service content or user information through automated means without written permission;
• send spam or harassing communications;
• infringe intellectual-property, privacy, publicity, or other rights;
• misrepresent your identity, affiliation, listings, products, or services;
• use the Services in a manner that creates unreasonable risk or burden for BoatRex or others.

BoatRex may investigate violations and cooperate with law enforcement where appropriate.

8. Third-Party Services and Links

The Services may contain links to or rely on third-party websites and providers, including payment, email, mapping, hosting, and other services. BoatRex does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. Your use of third-party services is governed by their terms.

9. Intellectual Property

The Services, including BoatRex branding, software, page designs, text, graphics, and other content provided by BoatRex, are owned by BoatRex or its licensors and are protected by intellectual-property laws. Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services without written permission.

10. Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Services, you acknowledge the practices described in that policy.

11. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access, remove content, or restrict features if we reasonably believe you have violated these Terms, created risk or legal exposure, failed to pay applicable fees, or used the Services in a way that may harm BoatRex or others.

Provisions that by their nature should survive termination will remain in effect, including ownership, disclaimers, limitations of liability, and dispute provisions.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” BoatRex disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or accurate, or that listings, users, businesses, boats, facilities, or services will meet your expectations.

13. Limitation of Liability

To the fullest extent permitted by law, BoatRex and its owners, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to the Services.

BoatRex’s total liability for claims arising from or related to the Services will not exceed the greater of the amount you paid to BoatRex during the 12 months before the event giving rise to the claim or $100.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BoatRex and its owners, officers, employees, and agents from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, your transactions or communications with others, or your violation of these Terms or another person’s rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the state where BoatRex is established, without regard to conflict-of-law rules. Any dispute will be brought in a court with jurisdiction over BoatRex unless applicable consumer law requires otherwise.

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.

16. Changes to These Terms

We may update these Terms as the Services evolve. We will post updated Terms here and revise the effective date. If a change is material, we may provide additional notice as required by law. Continued use of the Services after updated Terms take effect constitutes acceptance of the changes.

17. General Terms

These Terms and any additional terms presented for a specific feature constitute the entire agreement between you and BoatRex. If a provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; BoatRex may assign them in connection with a reorganization, merger, acquisition, or sale of assets.
